The family of a toddler who was killed last week by a falling cement truck has filed a lawsuit against the company responsible. On August 5th, a cement truck driver lost control of her vehicle and fell off of East Beltway 8 near Woodforest Blvd. The falling truck landed on a Ford Expedition with four members of the Resendiz family inside. Nicolas Resendiz, the 22-month-old boy, tragically died at the scene.

The boy’s mother and grandmother are the plaintiffs in the case. Jennifer, 22, and her mother, Maria, 54, escaped from the accident with minor injuries. They also rescued Nicolas’ twin sister from the wreck. They are seeking more than $1 million in damages from the cement truck company. Those damages include payment for medical expenses and wrongful death damages.

The driver of the cement truck, a 36-year-old woman, lost control of her truck during a brief rain storm. She lost control of her truck and smashed through a concrete barrier onto Frontage Road below. Though she sustained injuries in the crash, she refused to go to the hospital for treatment. It is unclear as of this writing whether or not the driver was intoxicated. However, authorities said she showed no signs of intoxication at the scene.

The lawsuit alleges negligence by National Ready Mix, LLC. This cement company is based in Kingwood, TX, just north of Humble.

The toddler was killed despite the best efforts of bystanders.

Multiple bystanders attempted to free the boy from the crushed SUV. Because the cement truck fell on the back of the Expedition, the two toddlers in the back seat were in the gravest danger. While good Samaritans were able to rescue the boy’s twin sister within a few minutes, it took emergency crews hours to free Nicolas.

Our hearts go out to the Resendiz family during this time of tragedy. Hopefully, they will be able to find peace and, eventually, justice for Nicolas as well.
